Need to evict your tenant right away?

Most landlords are unsure of how and when to file an eviction – at the end of the day, you are the landlord, and you need to get your tenant out of there…most of our new clients tell us that they are unsure of where to start.

Tenants have many eviction rights in California. You need someone who can navigate the ever-changing eviction landscape. Ever since the Covid-19 years and more recently during the California Fires, tenants are being provided with more and more rights.

Issuing the correct eviction notices and filing the proper court documents is a critical part of the eviction process…making the process go as quick and smooth as possible.

At Los Angeles Paralegals, we will issue the proper eviction notice and City of Los Angeles Housing Department / HCIDLA (Los Angeles Housing and Community Investment Department) forms right away, so there is no delay in getting your eviction started. After serving your tenant with the above-mentioned notices, we take care of uploading the notices.

From there we prepare, file with the Los Angeles Court, serve your tenant with the Unlawful Detainer Complaint and supporting forms. Your tenant has between 5 to 10 days to file a response. Depending on the type of response, we can have your tenant evicted within 2 months from the Unlawful Detainer Complaint being served.

* Please note as of April 2026, Los Angeles County has doubled the minimum rent debt required before a landlord can pursue eviction for nonpayment — a landlord may not proceed with an eviction for nonpayment unless the tenant's total unpaid balance exceeds two months of fair market rent — up from the prior one-month threshold. Single-family homes are not exempt. Although they are excluded from the ordinance's rent control provisions, they remain subject to its just cause eviction provisions — and the new two-month threshold applies. Please ensure that you provide the correct eviction notices and file at the right time.

How will your tenant respond?

More than 95 percent of tenants file an Answer. If they file an Answer, the next steps towards winning your eviction case happen rather quickly. Our "One-Price" Flat Fee Pricing guarantees just that.

However, in some instances, your tenant will delay the eviction case by filing responses or motions with the court. Your tenant may file a Demurrer, Motion to Quash Service of Summons, Bankruptcy, Motion to Stay and/or Motion to Transfer Venue. We can promptly respond to any of these motions.

What happens after you win your eviction case?

Once you win your eviction case, we will file the Judgment and Writ of Possession with the courthouse. Then, we will prepare the required Sheriff's Instructions and record it with the appropriate Sheriff's Office.

The Sheriff's Office takes about 2 weeks to post a Notice to Vacate. Once the Notice to Vacate is posted, it takes an additional week for the lockout to occur. There are additional court expenses for the Writ of Possession and having the Sheriff serve the Notice to Vacate, which includes the cost of accompanying the locksmith during the day of the lockout.

Most debtors qualify for filing Chapter 7 in Los Angeles with our "One-Price" Flat-Fee Filing. Even people with homes in Los Angeles, with less than approximately $600,000 in equity can now file under Chapter 7.
